7 ४ क यत व क तव य Maharashtra Administrative Tribunal is a Judicial body. It decides the cases instituted against the Government of Maharashtra by its employees in respect of disputes on service matters. In this connection, Section 15 which deals with Jurisdiction, Powers and Authority of State Administrative Tribunals reads as under: (1) Save as otherwise expressly provided in this Act, the Administrative Tribunal for a State shall exercise, on and from the appointed day, all the jurisdiction, powers and authority exercisable immediately before that day by all courts (except the Supreme Court) in relation to (a) recruitment, and matters concerning recruitment, to any civil service of the State or to any civil post under the State; (b) all service matters concerning a person (not being a person referred to in clause (c) of this subsection or a member, person or civilian referred to in clause (b) of sub-section (1) of Section 14) appointed to any civil service of the State or any civil post under the State and pertaining to the service of such person in connection with the affairs of the State or of any local or other authority under the control of the State Government or of any corporation (or society) owned or controlled by the State Government; (c) all service matters pertaining to service in connection with the affairs of the State concerning a person appointed to any service or post referred to in clause (b), being a person whose services have been placed by any such local or other authority or corporation (or society) or other body as is controlled or owned by the State Government, at the disposal of the State Government for such appointment. मह र ष ट र प रश सक य न य य धधकरण त ल पद धधक र, अधधक र य च अधधक र व कतनव य च म. अध यक ष, मह र ष ट र प रश सक य न य य धधकरण, म बई य च अधधक र व कतनव य :- तपश ल :- 5 As per provisions of Section 5 of Administrative Tribunals Act, 1985, the Chairman of Maharashtra Administrative Tribunal (a) may, in addition to discharging the functions of the Judicial Member or the Administrative Member of the Bench to which he is appointed, discharge the functions of the Judicial Member or, as the case may be, the Administrative Member of the Bench; (b) may transfer the Vice-Chairman or other Member from one Bench to another Bench; (c) may authorize the Vice-Chairman or the Judicial Member or the Administrative Member appointed to one Bench to discharge also the functions of the Vice- Chairman or, as the case may be, the Judicial Member or the Administrative Member of another Bench; d) may, for the purpose of securing that any case or cases which, having regard to the nature of the questions involved, requires or require, in his opinion or under the rules made by the State Government in this behalf, to be decided by a Bench composed of more than two Members;

8 6 7 (e) Chairman either himself or may authorize any other Member by issuing an order to function as a Bench consisting of a single Member and exercise the jurisdiction, powers and authority of the Tribunal in respect of such classes of cases or such matters pertaining to such classes of cases as the Chairman may by general or special order specify: As per Section 25 of the Administrative Tribunals Act, 1985, the Chairman on the application of any of the parties and after notice to the parties, and after hearing such of them as he may desire to be heard, or on his own motion without such notice may transfer any case pending before one Bench for disposal to another Bench. As per Section 26 of the Administrative Tribunals Act, 1985, the Chairman is having power either to hear himself or refer the case to other Members for hearing the case on such point where the Members of the Division Bench are of difference of opinion. As per Section 12 of the Administrative Tribunals Act, 1985 and as per provisions of Maharashtra Administrative Tribunal (Financial & Administrative Power) Rules, 1991, the Chairman is having power to exercise all the financial and administrative मह र ष ट र प रश सक य न य य धधकरण च न य धयक अधधक र त :- powers which are vested in the Secretary of a Ministerial Department of the State Government. As per provisions of Rule 27 and 28 of the Maharashtra Administrative Tribunal (Procedure), Rules, 1988, the Chairman is having power to fix the sitting hours of Tribunal and working hours of the Tribunal. As per provisions of Rule 29 and 30 of the Maharashtra Administrative Tribunal (Procedure) Rules, 1988, the Chairman is having power to issue orders to the Registrar, Maharashtra Administrative Tribunal and assign the work as he deems fit. As per provisions of Rule 33 of the Maharashtra Administrative Tribunal (Procedure) Rules, 1988, the Chairman is having power to specify the dress of Chairman, Vice-Chairman and Members and Staff Members of the Tribunal. Maharashtra Administrative Tribunal decides the disputes on following subjects by sitting as Single Bench. Consolidated list of the subjects coming within the jurisdiction of Single Bench. :-

9 8 9 a. Change of date of birth. b. Transfer / Posting on transfer which includes retransfer or repatriation or implementation of transfer. c. Entry(s) in character rolls made otherwise than as a measure of penalty under Maharashtra Civil Services (Classification, Control and Appeal) Rules, d. Allotment of Government accommodation and eviction therefore under the orders of an executive authority on transfer or termination of service. e. Claims pertaining to grant/ refusal of leave, determination of nature of leave, affixing or suffixing holidays/ vacations to leave period, conversion of leave of one kind into another. f. Money claims pertaining to Medical Reimbursement. Leave Encashment while in service, Leave Travel Concession and Overtime Allowance, Delayed Wages and/or Allowance while in service or on Suspension and Money Claims arising out of rules, resolutions and regulations. g. Crossing of Efficiency Bar. h. Claim due on account of stagnation at a stage in pay scale. i. Family Pension, Grant/ Refusal thereof (not involving the question of inheritance or devolution under personal law) and quantum of pension amount as per rules, regulations and decisions. j. Grant or Refusal to grant/ advances/loans. k. Disputes regarding recoveries purporting to be under the Rules of Monetary claims of the Government including these of overpayments, loss to Government or its property, unauthorized use of Government property or Government vehicle, misappropriation of moneys due to Government. l. All disputes or matters pertaining o the appointment, renewal of appointment, payment of honorarium, penalties imposed for neglect of duty including suspension, removal and dismissal etc., in respect of Police Patils and other statutory lower tenure post of the type to be filled in by District or sub Divisional authorities in District. m. Omission in fixation/ determination/payment of provisional pension/pension/ pensionary benefits and amount of interest on delayed payments thereof. n. Disputes regarding penalty of reduction of pension in cases not

10 10 11 involving misappropriation of Government money or moneys due to Government or moneys pay to the Government agency or in cases not involving conduct involving a crime or moral turpitude or failure to refund to the Government amount overpaid to the Government servant or otherwise due from him to the Government. o. All matters pertaining to penalties under any enactment or rules except the following:- Dismissal from service. Removal from service. Compulsory Retirement from service by way of punishment only. But this would not include premature or compulsory retirement under any rule after completion of specified service. Reduction in rank for a period exceeding three years. Debarring an employee for promotion permanently. p. All the matters in which validity of suspension determination of suspension period and the claim of payment during the period of suspension. q. Refusal of stagnation benefit with or without reason. This would include refusal to grant benefit of time bound promotion scheme or any other similar such scheme. म. सदस य, मह र ष ट र प रश सक य न य य धधकरण, म बई य च अधधक र व कतनव य :- s. Refusal to confirm permanency benefits with or without reason. t. Refusal of advance increments with or without reason. All other matters are to be decided by Division Bench of Maharashtra Administrative Tribunal. If a serious law point is involved them Chairman can constitute a Full Bench consisting of 3 or more Members. 1) To decide all the cases transferred to him by Chairman. 2) To decide the cases as the Member of Division Bench and Single Bench as the case may be. 3) To exercise the power vested in him as per Section 30 of the Administrative Tribunals Act, ) To exercise all powers delegated to him by Chairman.

In addition to it, the Registrar to do the duties as vested in him vide Rule 29, 30 and 31 of Maharashtra Administrative Tribunal (Procedure) Rules, रनणतय प ररक रय त ल पयतव क षण व जब बद र च उत तरद रयत व क यतपध दत - In Maharashtra Administrative Tribunal, there are two channels for taking decisions a) Judicial Decisions b) Administrative Decisions 1) The procedure followed in Maharashtra Administrative Tribunal for Judicial Decisions i.e. Journey of a case. In Maharashtra Administrative Tribunal the cases are divided into following categories a) Original Application b) Transfer Application c) Miscellaneous Application d) Review Application e) Contempt Application f) Transfer application from one Bench to another Bench 2) The Maharashtra Administrative Tribunal following the procedure for resolution of disputes as under: (a) (b) (c) (d) (e) (f) Institution of cases. Scrutiny of cases. Correction of mistake and supply of omissions as the case may be. Service of notices to parties. Receiving Reply, Rejoinder, etc. Hearing of the cases on interim relief and Misc. application. 13

Destruction of Records as per Rules. i) In Contempt Application, the notices are to be issued by the Bench after hearing the complainant. ii) In case, there is urgency the circulations can be issued directly by Benches. 3) Channel of supervision and accountability. In Maharashtra Administrative Tribunal, Chairman is the Head of the Department and as per provisions of Rule 4 of the Maharashtra Administrative Tribunal (Financial & Administrative Power) Rules, 1991, he is the supervising authority of the whole business of the Maharashtra Administrative Tribunal and everybody is accountable for his work to the Chairman. क म च रनपट र करण स ब ध ठररवण य त आल ल रनकष - a) So far as judicial business is concerned, no norms are set but the past record of Maharashtra Administrative Tribunal discloses that even without setting the monthly norms, the disposal rate in Maharashtra Administrative Tribunal is so high that it is having very less pendency of cases in comparison to other Courts and Tribunals dealing with the judicial matters. b) So far as norms for disposal of administrative files are concerned, there are directions of Hon ble Chairman that the administrative business should be disposed of either on the same day or on next day or within reasonable period; therefore, there is no pending work in Maharashtra Administrative Tribunal.

Definition.-- In these rules, unless the context otherwise requires:-- (a) "Act" means the Administrative Tribunals Act, 1985 (13 of 1985); (b) "agent" means a person duly authorised by a party to present an application or a written reply on its behalf before the Tribunal; (c) "applicant" means a person making an application to the Tribunal under Sec. 19; 47 (d) "form" means a Form specified in Appendix A; (e) "Government" means the Government of Maharashtra; (f) "legal practitioner" shall have the same meaning as is assigned to it in the Advocates Act, 1961 (25 of 1961); (g) "legal representative" means a person who in law represents the estate of the deceased; (h) "Registrar" means in relation to the Tribunal the Registrar appointed to the Principal Bench and in relation to each of the other Benches of the Tribunal shall mean the Registrar appointed to the particular Bench and include any officer to whom the powers and functions of the Registrar may be delegated under Cls. (2) and (3) of rule 29; (i) "Registry" means the Registry of the Tribunal or of the Bench of the Tribunal as the case may be; (j) "section" means a section of the Act; (k) "transferred application" means the suit or other proceeding, which has been transferred to the Tribunal under sub-section (1) and (2) of Sec. 29; (l) "Tribunal" means the Maharashtra Administrative Tribunal established under sub-section (2) of sub-sec. 2 of Section 4 of the Act;

29 48 49 (m) the words and expressions used and not defined in these rules but defined in the Act shall have the same meanings respectively assigned to them in the Act. 3. Language of the Tribunal.-- The language of the Tribunal shall be English: Provided that the parties to a proceeding before the Tribunal may file documents drawn up in Marathi/if they so desire; Provided further that - (a) a Bench may, in its discretion, permit the use of Marathi in the proceedings. However, the final order shall be in English; (b) the Bench, hearing the matter, may in its discretion, direct English translation of pleadings and documents to be filled. 4. Procedure for filing application.-- (1) An application to the Tribunal shall be presented in Form I by the applicant in person or by an agent or by a duly authorised legal practitioner to the Registrar or any other officer authorised in writing by the Registrar to receive the same or be sent by registered post with acknowledgement due addressed to the Registrar of the Bench concerned. (2) The application under sub-rule (1) shall be presented in triplicate in a paper-book form alongwith the one unused file size envelope bearing full address of the respondent. (3) Where the number of respondents is more than one, as many extra copies of the application in paper-book form as there are respondents together with unused file size envelope bearing the full address of each respondent shall be furnished by the applicant: Provided that, where the number of respondent is more than five, the Registrar may permit the applicant to file the extra copies of the application at the time of issues of notice to the respondents. (4) The applicant may attach to and present with his application a receipt slip in Form II which shall be signed by the Registrar or the Officer receiving the application on behalf of the Registrar in acknowledgement of the receipt of the application. (5) Notwithstanding anything contained in sub-rules (1) to (3), the Tribunal may permit-- (a) more than one person to join together and file a single application if it is satisfied, having regard to the cause of action and the nature of relief prayed for, that they have a common interest in the matter. (b) Such permission may also be granted to an

30 50 51 association representing the persons desirous of joining in a single application provided, however, that the application shall disclose the class/grade/categories of the persons on whose behalf it has been filed. 5. Presentation and scrutiny of applications.-- (1) The Registrar, or the other officer authorised by him under rule 4, shall endorse on every application the date on which it is presented or deemed to have been presented under that rule and shall sign the endorsement. (2) If, on scrutiny, the application is found to be in order, it shall be duly registered and given a serial number. (3) If the application, "on scrutiny" is found to be defective and the defect noticed is formal in nature, the Registrar may allow the party to rectify the same in his presence and if the said defect is not formal in nature, the Registrar may allow the applicant such time to rectify the defect as he may deem fit. (4) If the applicant fails to rectify the defect within the time allowed under sub-rule (3), the Registrar may, by order and for reasons to be recorded in writing, decline to register the application and inform the applicant accordingly. (5) An appeal against the order passed under sub-rule (4) may be preferred by the person aggrieved within fifteen days from the date of such order to the Chairman in the case of Principal Bench and to the Vice-Chairman concerned, in the case of any other Bench and such appeal may be dealt with and disposed of in the chamber of the Chairman or the Vice-Chairman concerned or in their absence, any Member authorised by the Chairman by special or general order, whose decision thereon shall be final. 6. Place of filing applications.-- The application shall ordinarily be filed by the applicant with the Registrar of the Bench within whose jurisdiction-- (i) the applicant is posted for the time being, or (ii) the cause of action has arisen, or (iii) the respondent or any of the respondents against whom relief is sought, ordinarily resides: Provided that the application may be filed with the Registrar of the Principal Bench and subject to Sec. 25 of the Act, such application may be transmitted to be heard and disposed of by the Bench which has jurisdiction over the matter. 7. Application fee.-- Every application filed with the Registrar shall be accompanied by a fee of rupees fifty to be remitted either in the

31 52 53 form of cross demand draft on a nationalised bank in favour of the Registrar of the concerned Bench and payable at the main branch of that bank at the station where the seat of the said Bench is situated, or remitted through a Crossed Indian Postal Order drawn in favour of the Registrar of the concerned Bench and payable at the post office of the station where the said Bench is situated: Provided that where the Tribunal permits a single application to be filed, either by more than one person or by an Association, the fee payable shall be rupees fifty; Provided further that where the Tribunal is satisfied that an applicant is unable to pay the prescribed fee on the ground of indigence, it may exempt such an applicant from the payment of fee. 8. Contents of application.-- (1) Every application filed under rule 4 shall set forth concisely under distinct heads, the grounds for such application. Such grounds shall be numbered consecutively. Every application, including any miscellaneous application shall be typed in double space on one side on thick paper of good quality. (2) It shall not be necessary to present a separate application to seek an interim order or direction if in the original application the same is prayed for. (3) An applicant may, subsequent to the filing of an application under Sec. 19 apply for an interim order or direction. Such an application shall, so far as possible, be in Form III. 9. Documents to accompany the application.-- (1) Every application shall be accompanied by a paperbook containing:-- (i) an attested true copy of the order against which the application is filed; (ii) copies of the documents relied upon by the applicant and referred to in the application; (iii) an index of the documents. (2) The documents referred to in sub-rule (1) may be attested by a legal practitioner or by a gazetted officer and each documents shall be marked serially as Annexure A1, A2, A3 and so on. (3) Where an application is filed by an agent, documents authorising him to act as such agent shall also be appended to the application: Provided that where an application is filed by a legal practitioner, it shall be accompanied by a duly executed vakalatnama.
